Korean Juvenile Act article 32 paragraph (1) are defined as following: In case where it is deemed necessary to order protective detention of a juvenile as result of a trial, the judge of the competent Juvenile Department shall, by means of a ruling, make disposition falling under any of following sub-paragraphs (……) 7. To entrust a juvenile concerned to a hospital, a sanatorium or a juvenile medical care and protection institution under the Treatment of Protected Juvenile etc. Act. The purpose of this provision is to provide medical treatment for juvenile offender with mental disorders or physical illness. In case of the United States, it has been operating drug treatment courts and mental health courts for juveniles, in Japan, it has been conducting a special correction education with professional medical treatment in 4 juvenile medical reformatory for the girls/boys who are suffered from mental disorder and physical illness. Also in Germany, there are broadly linked social networks which can provide juvenile court treatments to impose various kinds of educational aid and training from different institutions and systems for juvenile delinquent. Unlike other countries, in Korea only one institution(Daejeon Juvenile Reformatory) has been conducting medical care service and correction education for the juvenile delinquent suffering from mental disorder and physical diseases. This essay focuses on Ana1yzing some institutional problems on juvenile justice system, and suggesting some alternatives aiming at improvement of juvenile medical care and protection institution. The rough categories of alternatives for improvement for those are reform of trusting disposition in Juvenile Act, separate accommodation as well as individualized treatment of juvenile delinquent, independent facilities aiming at professional medical care and rehabilitation treatment etc.
