법교육의 필요성과 보호관찰의 패러다임 전환 - 보호관찰소의 법교육 필요성 및 발전방향을 중심으로 -

본 연구는 보호관찰제도를 수행하는 보호관찰소의 역할이 종래 전통적인 보안처분의 시각에서 벗어나야 함을 강조하고, 그 동안 보호관찰소가 교육대상자들에게 실시하였던 준법교육의 범위를 보다 확장하여 일반 법교육을 수행하는 새로운 기능을 담당하는 기 관으로 전환되어야 하는 당위성과 활성화 방안을 살펴보고자 하였다. 우리나라의 법교육 사업은 2000년대 중반 법무부를 중심으로 국가기관의 지원이 본격 화되면서 학교 안팎을 넘나드는 다양한 사업이 전개되어 지난 10년 동안 많은 발전을 하였다. 그러나 법교육 사업측면에서 볼 때 보다 다양한 내용의 법교육을 보급하고 대중 화하기 위해서는 전국단위 법교육 네트워크를 갖추고 이를 통하여 법교육을 시행할 필요가 있었다. 그리고 보호관찰소라는 기관의 입장에서는 기존 님비현상 해소, 범죄에 대한 사전예방의 중요성 대두, 규제행정에서 급부행정으로의 기능 다변화 필요성 등의 이 유로 법교육을 실시해야할 필요가 있었다. 이처럼 보호관찰소가 보호관찰의 전통적인 기능의 하나인 수강명령제도라는 준법교육을 넘어 일반인에 대하여 법교육을 실시하는 것은 법교육이 필요한 현장과 보호관찰소 기관 양측 관점에서 볼 때 타당한 요청에 따 른 것이라 할 수 있다. 다만, 크게 성장하는 법교육 사업을 더욱 활성화시키기 위해서는 강사의 전문화와 전문인력의 활용, 컨텐츠의 다양화, 수요자별 교육 세분화, 청소년비행 예방센터와의 연계문제 등의 과제가 수행되어야 한다.

The Necessity of Law-Related Education and Conversion of the paradigms of probation

This study emphasizes that the role of the probation office performing the probation system should be deviated from the perspective of traditional security measure. In addition, the probation office should be transformed into an institution that provides new functions that extend the scope of previous compliance education that has been provided to the subjects of education, and that provides Law-Related Education(LRE). The purpose of this paper is to clarify the necessity of the conversion of the duty of the probation office and to suggest ways to activate it. In the midst of the 2000s, the Ministry of Justice and other governmental agencies began to support the Law-Related Education programs in Korea. As a result, various projects have progressed. However, in terms of Law-Related Education business, in order to disseminate and popularize more diverse contents of Law-Related Education, it was necessary to have Law-Related Education network through nationwide education system. In addition, from the organizational viewpoint of Law-Related Education it was necessary for the probation office to play a diverse and active role beyond traditional functioning. It is required to change the function of the probation office in order to overcome these problems. In other words, as the main functions of administration change from regulatory administration to benefit administration and the importance of preventive measures against crime is emphasized, it is necessary to make a change as a main authority of Law-Related Education(For the sake of simplicity in this article, we will call ‘the Compliance Support Center’). Conventional probation offices were in charge of compliance education, which is a lecture order system. Therefore, enforcing Law-Related Education for ordinary people beyond compliance education is not a complete change of duty of the organization. Therefore, in order to cope with the demand of the field that requires Law-Related Education and to expand the role of the probation office itself, it is reasonable that the probation office should make Law-Related Education as its main task. However, there are some points to be emphasized in order for the probation office to activate the Law-Related Education business in the stage of growth. In other words, specialization of teachers who are in charge of Law-Related Education in the field is needed, and an organizational system that can utilize the experts in Law-Related Education should be established. In addition, education contents should be diversified in terms of contents of Law-Related Education and education contents should be subdivided so that individual responders can cope appropriately. Finally, a cooperative relationship should be established so that it can be linked to education and business with the related agency, the Juvenile Delinquency Prevention Center.
