In the principle of criminal justice, mentally disordered offenders who can not distinguish the essence of right and wrong or control one’s own behavior have no criminal responsibility. To guarantee their health rights and help adapting to the community, Mental Health Treatment Order was legislated and are in the process of implementing in December 2016. The problem is how to accurately detect the malingerers who fake the mental disorder, avoid criminal responsibility and even snatch away the therapeutic benefits. Even though the prevalence of malingering is maintained at least 20% of criminal cases, it is estimated that there will be more attempts to abuse the Mental Health Treatment Order. Therefore, the purpose of present study was to examine the applicability of the Korean version of SIRS-2. The 106 college students was randomly assigned to the control-genuine group or malingering group and their SIRS-2 data was used to analyze the internal validity. The results of the study showed that there was significant difference both in the SIRS-2 diagnosis and subscale scores between the control-genuine group and the malingering group. These results indicate that SIRS-2 has an excellent function to accurately distinguish the feigned symptoms. Finally, the implications and limitations of this study were discussed for the future research.
