소년 보호관찰 분야에서의 증거기반 정책 채택과 향후 과제
본 논문은 최근 서구에서 활발히 논의되고 있는 소년사법 분야에서의 증거기반정책(EBP) 현황을 검토하고, 우리나라 소년 보호관찰 분야에서의 증거기반 정책 채택을 위한 향후 과제를 논의하고 있다. 본 논문의 제1장에서는 소년사법에서의 증거기반 정책의 심도 있는 논의를 위해, 미국의 증거기반 정책에 관한 역사적, 이론적 맥락을 검토하였고, 소위‘위험성-욕구-반응성(RNR)’원칙을 그 이론적 준거틀로 제시하였다. 최근 제시된 일련의 연구결과는 MST 등 가족치료, 인지행동 프로그램들의 재범방지 효과성에 대해 일관되게 보고하고 있으며, 쇼크구금 등의 프로그램에 대해서는 재범방지 효과가 없다고 보고하고 있다. 본 논문의 제2장에서는 한국 보호관찰 현장에서의 증거기반 원칙 구현정도를 간략히 평가하였다. 미국 범죄사법연구소의‘지역사회 교정에 있어서의 증거기반 8원칙’과 립시(Lipsey, 2012)가 개발한‘프로그램 평가 표준안’(SPEP)에 따라 한국의 소년 보호관찰과 수강명령을 평가한 결과, 아직 소년사법 관련 증거기반 정책들이 국내에서는 초기단계에 머물고 있는 것으로 나타났다. 마지막으로 증거기반 원칙들이 국내에 안정적으로 정착하기 위한 선결과제를 검토하고, 증거기반 소년 보호관찰제도의 정착을 위한 제언으로 1) 소년 보호관찰의 철학적 지향점 명시 등 증거기반 정책 실시를 위한 기반 조성, 2) 소년보호처분 배치 메트릭스 도입 등 법원단계에서의 증거기반 원칙 실현방안 강구, 3) 재범 고위험 청소년에 대한‘재활형 집중 보호관찰’실시, 4) 성과평가 체계 개편 등 증거기반 정책의 효과적 이행방안 강구 등을 제시하였다.
The current status and future directions of evidence-based policy in juvenile probation and parole
This essay attempts to introduce the current status of evidence-based policy in juvenile probation and parole in Korea and offer ways to improve the current probation practice from the EBP perspective. The first chapter, largely based on western experiences, discusses the development of EBP from historical contexts followed by theoretical foundations such as the RNR principle. Some of the evidence based programs are also provided in order to further guide discourse on EBP. The second chapter assesses the degree to which the EBP principles are implemented in Korean contexts, getting to the conclusion that EBP is not yet well established in Korean juvenile probation and parole practices. Finally, this essay concludes by providing some suggestions on how to improve the current juvenile probation practices from the perspective of EBP. Among others, an introduction of placement matrix at the disposition stage is strongly suggested in order to get the EBP principles fulfilled. An implementation of IRP (intensive rehabilitative probation) against high risk juvenile probationers is also suggested.
