Our country's electronic monitoring system, which guides, cares for and helps those who served out sentences after committing specific crimes, through probation to prevent their repeated crimes, aims to help them return to the society healthily and to protect people from specific crimes by means of additional measure of attaching electronic devices to them for position tracking. This Electronic Device Attachment Act not only has extended the applicable crimes and attachment periods through totally 11 law revisions so far but also was recognized for its adequacy for its retrospective application by the ruling of the Constitutional Court, resulting in the tendency of the exponential increase of the targets. In step with this trend, the Ministry of Justice has been improving personal and physical networks using diverse measures such as open of position tracing control center, formation of quick response teams for electronic monitoring within probation offices, new establishment of the department for administration of specific crime offenders within the Ministry of Justice and probation offices, obligatory probation for those who completed their sentences, distribution of all-in-one electronic devices, the increase of the engaged manpower. That said, measures to improve the problems taking place during the implementation of electronic monitoring scheme are continually required as well. These problems include the occurrence of repeated crimes during the period of electronic device attachment, damages of electronic devices, the increase of the number of subjects to take care by one staffer, their mental pressure due to the long attachment of electronic device and depressed social lives, still low temporary relief rate. Under the circumstances, this study sought to conduct analysis on the achievements of electronic monitoring scheme commemorating the 11 years after its implementation. In the first place, it grasped legal nature of electronic monitoring in the general of the electronic monitoring schemes and examined the adequacy of retrospective application for sexual crime offenders relative to the former. Then the study analyzed centered on the present state of execution/ offenders/attachment period respectively, the state of staffers in charge and in control, the state of repetition of specific crimes, the state of incidents of damaged electronic devices, the state of claims for attachment instruction after completing the sentences and the state of announcements. Over the course of the analysis, the study attempted to evaluate a number of issues caused during the process of its application. For the development direction in the future, the study, based on the analysis on achievements as such, suggested the application of electronic monitoring scheme subjected to parole, measures to strengthen the protection of the victims, the expansion of crime symptom prediction system.
