소년보호처분 전(前) 개입에 관한 일본 제도 연구
법무・검찰개혁위원회는 2020. 4. 27. ｢소년범죄 처리절차 개선 및 소년피해자 지 원 강화｣에 대하여 심의, 의결하고, 소년범죄 처리절차 개선, 소년피해자 지원 강화, 소년범죄 총괄 조직 신설 및 전담검사 육성 권고를 내용으로 하는 법무・검찰 개혁 위원회 제17차 권고를 발표하였다. 권고안의 주요골자는 크게 소년범죄의 처리절차 중 재판 전 보호관찰제도를 신설하고 피해자 지원을 위한 제도를 강화하는 것으로 이루어져 있는데, 그 내용 중 일부는 7. 8. 백혜련의원이 대표발의한 소년법 일부개 정법률안(의안번호: 1664)에 반영되었다. 본고에서는 이러한 권고안이나 개정법률안에서 제시한 바와 같이 과연 법원(소년 부)의 종국결정 전에 일정한 강제를 동반하는 개입을 허용하는 것이 비교법적으로 그 예를 찾아볼 수 있는지에 관하여 살펴보았다. 특히 일본의 소년법제를 중심으로 검토하였으며, 그중에서도 관호조치, 시험관찰, 보호적 조치의 내용과 그 시사점을 제시하였다.
A Study on the Japanese System on the Intervention Before the Disposition of Juvenile Protection
The Legal and Public Prosecutors Reform Committee deliberated and decided on the "improvement of juvenile crime handling procedures and strengthening support for juvenile victims," and issued the 17th recommendation of the Legal and Public Prosecutor Reform Committee, which calls for improving juvenile crime handling procedures, strengthening support for juvenile victims, establishing a general organization for juvenile crimes, and fostering dedicated prosecutors. The main focus of the recommendation is largely on establishing a pre-trial probation system and strengthening the system for supporting victims during the process of dealing with juvenile crimes, some of which were reflected in the revised juvenile law bill (bill No. 1664, hereinafter, revised bill) represented by Baek Hye-ryeon. As suggested in this recommendation or revised bill, the paper looked at whether it could find a foreign legislative case allowing intervention with certain coercion before the court's decision. Especially, the juvenile legislation system of Japan was reviewed.
