보호수용제도 도입을 위한 선결과제
형벌과 보안처분 이원주의 입장에서 보면 상습범, 누범의 가중처벌규정을 폐지하 고 보호수용제도를 도입하려는 취지는 공감할 수 있다. 특히 종래 보호감호제도의 문제점을 감안하여 집행유예제도를 도입하고 가출소에 대한 필요적 심사제도 등을 마련한 것은 긍정적으로 평가할 수 있다. 다만, 보호수용제도의 도입은 여전히 이중 처벌 내지 과잉금지 위반의 의문을 피하기 어려운 문제이다. 특히 제도의 이론적 정 당성과는 별개로 현실적 타당성의 측면에서 보면 보호수용의 집행에 대한 구체적인 대안이 마련되어 있지 않으면 특히 자유형의 집행과 차별성을 확보하기 어려우므로 대상자의 입장에서 보면 이중처벌이라고 의식을 할 수밖에 없는 것이다. 구 사회보 호법의 폐지와 함께 폐지되었던 보호감호처분을 부활시키는 것으로 인식될 우려가 있고, 보호감호처분의 재도입은 과거와 동일한 문제점을 야기할 수 있다는 우려도 어느 정도 타당하다 볼 수 있다. 보호수용제도의 도입에 있어서 이러한 우려를 불식 시키기 위한 신중한 준비검토가 요구된다. 피보호수용자들을 위한 특별한 시설이나 사회내 처우, 지역사회의 협조체제가 갖추어지지 않은 상태에서 서둘러 보호수용제 도의 도입만 서두른다면 피보호수용자들은 이중처벌이라는 억울함과 절망감에서 수 용생활을 지옥처럼 느끼게 될 것이다. 따라서 보호수용처분의 집행에서도 상습범죄 자들에 대한 교정과 재사회화를 위한 획기적 처우 프로그램이 필요할 것이다. 그리 고 보호수용이 효과를 얻으려면 사회내 처우, 사회 공동의 취업 알선, 민간 전문가들 이 참여하는 지역내 프로그램의 마련이 우선되어야 할 것이다. 이외에도 적정한 보 호수용제도의 도입을 위해서는 새로운 연구와 노력들이 더욱 필요할 것이다.
Prerequisite for Introduction of Protection Accommodation System
From a dualistic viewpoint of punishment and protective measures, it is a reasonable effort to abolish aggravated punishment for habitual criminals and introduce protective accommodation instead. Particularly, it seems positive that a probation was introduced to resolve problems of the protective custody, and a screening process was adopted for a parole. Still, the newly introduced protective accommodation poses a question over double punishment and a breach of the principle of proportionality. It is a valid concern that the new system might be akin to reviving protective custody that was scrapped together with the Society Protection Act in the past, which might give rise to the same problems. A cautious approach is needed in introducing protective accommodation to mitigate these concerns. Hastily introducing protective accommodation without sufficient considerations over facility for people under protective accommodation, their treatment in society, and cooperation from local community would make those under protective accommodation feel wronged and in despair, and find this arrangement unbearable. To avoid this, an innovative program should be designed to help correction and rehabilitation of habitual criminals. For effective implementation of protective accommodation, a local community program should be established that provides fair treatment to people under protective accommodation and helps them with finding employment, with participation of private-sector experts. Going forward, more research and endeavors are needed to manage protective accommodation properly.
