성범죄자의 긴장(strain)과 재범에 관한 질적 연구 : 1:1 전자감독 대상자들을 중심으로
본 연구는 우리나라 최고 위험군으로 분류된 아동・청소년 대상 성범죄자에 대한 면담을 통해 이들의 범죄 상황과 재범, 준수사항 위반 상황을 일반긴장이론을 통해 살펴보고자 하였다. 이를 위하여 1:1 전자감독 대상자로 지정된 성범죄자 전수 20명 에 대하여 면담과 구조화된 설문조사를 진행하였다. 연구내용은 일반긴장이론이 제 시하는 부정적 감정과 긴장을 유발하는 부정적 자극의 출현과 긍정적 자극의 소멸 상황을 중점으로 하여 과거 범죄행위, 보호관찰을 받았을 때의 재범, 그리고 1:1 전 자감독 대상자가 된 이후의 준수 사항 위반과 연결점을 찾았다. 연구 결과, 1:1 전자 감독 대상자가 된 성범죄자들의 범죄, 재범 그리고 위반사항 직전에는 부정적인 자 극의 출현 혹은 긍정적 자극의 소멸이라는 Agnew가 주장한 부정적 감정의 원인이 선행되었음을 확인할 수 있었다. 그리고 대부분의 1:1 전자감독 대상자들은 이러한 부정적 상황을 알코올 사용을 통한 회피 혹은 폭력을 활용한 분노 표현으로 부정적 감정에 대처함을 확인할 수 있었다. 본 연구 결과를 활용한다면 1:1 전자감독을 담당 하는 보호관찰관들은 담당 대상자들의 긴장 혹은 스트레스 유발 요인을 파악하려 해 야하며 대상자들이 직면하는 부정적 감정 상황이 범죄적 상황과 직결되지 않도록 심 리상담 및 치료 전문가와 함께 긴장 대처방안을 고민해야 할 것이다. 1:1 전자감독을 담당하는 보호관찰관은 단순히 성범죄자의 준수사항 위반 여부에 집중된 지도감독 방식에서 벗어나 1:1 전자감독 대상자들에게 제도적으로 제공 가능한 심리상담 및 치료 기회를 적절히 활용하여 긴장과 부정적 감정 요인이 회피(알코올 혹은 약물 의 존)나 폭력으로 표출되지 않도록 지도할 수 있어야 할 것이다.
A Qualitative Study on Strain and Recidivism of Sex Offenders : Focusing on 1:1 Electronic Monitoring Subjects
The purpose of this study was to understand of criminal situation, recidivism, and violation of compliance rules by interviewing sex offenders classified as the highest risk group in Korea. Through interviews with a total of 20 sexual offender and the structured questionnaire for 21 same offenders, past criminal acts, recidivism when receiving probation, and violations of compliance and recidivism after becoming a subject of 1:1 electronic supervision, and negative situations was tried to contain. According to the interview, we found that there was the cause of negative emotions before their crimes, recidivism, and violations that Agnew argued, such as the appearance of negative stimuli or disappearance of positive stimuli of GST. It was confirmed that they coped with these negative emotions by expressing anger and strain through avoidance or violence. If probation officers could recognize that these negative emotional situations of sexual offenders were expressed just before their crime, recidivism, and violation of the compliance, they should not focus on whether or not they have violated the compliance, but rather the emergence of negative stimuli they face (e.g., family discord). In additions, the probation officers or consultants should make an effort to understand the negative emotions of sex offenders, and should pay attention to give a guidance on additional stress relief methods so that subjects who feel negative emotions do not express these emotions as direct avoidance(alcohol dependence) or violence. By utilizing these results in probation and counseling techniques based on the general strain theory, it is expected that more direct crime deterrent effect could be enhanced.
