독일 보호관찰제도에 관한 고찰 - 보호관찰제도의 발전과 형사실무상 새로운 논의-
본 논문에서는 독일 형법상 보호관찰의 발전과정과 보호관찰의 부과 대상 및 임무 등 주요 내용을 살펴보고, 지난 60년간의 보호관찰의 성과와 형사실무상 새로운 논의를 소개하고 있다. 독일의 보호관찰은 일반적으로 형법 제56조 보호관찰부 집행유예와 제56d의 보호관 찰에 의해 선고가 가능하며, 대상자에 따라 의무사항 또는 준수사항, 혹은 두 가지 모두를 이행할 것을 부과할 지의 여부는 법원에서 결정한다. 보호관찰은 재범방지와 범죄인의 건 전한 사회복귀를 목적으로 부과하는 사회내처우이기 때문에 범죄인을 직접 지도하고 감독 하는 보호관찰관의 임무 수행능력이 보호관찰의 성패를 좌우하기도 한다. 따라서 보호관찰 관의 전문화·개별화 능력에 대한 개발 방법과 다양한 프로젝트 등에 대한 연구가 중요하다 고 할 수 있다. 현재 독일 보호관찰 실무에서는 해당 보호관찰소 별 적용 가능한 방법으로 보호관찰관 연수를 위한 다양한 프로그램을 개발하고 적용하고 있다. 동시에 보호관찰 대 상자들을 생활 여건이나 문제별, 범죄별로 분류하여 처우하는 방법을 통해 대상자도 효과 적으로 처우하고, 보호관찰관도 분야별로 전문화 시킬 수 있는 방법을 개발하고 있다. 또한 보호관찰제도의 민영화에 대한 논의와 위험을 기반으로 한 보호관찰로의 변화 등 다양한 보호관찰 운영 프로젝트 및 접근방법의 변화를 통해 60년간 발전해 온 독일보호관찰제도의 새로운 변화를 꾀하고 있다. 한국 보호관찰실무에서도 대상자 처우의 다양화와 보호관찰의 변화가 요구되고 있는 현실 을 고려할 때 독일 보호관찰제도의 실무상 논의는 중요한 참고자료가 될 수 있다.
Betrachtung über die deutsche Bewährungshilfe - Die Entwicklung der deutschen Bewährungshilfe und die aktuelle Diskussion in der strafrechtlichen Praxis -
This paper deals with the development of Probation in Germany, the criteria of its placement on probation and the role of the probation officer. Here, the success of the probation service in the last 60 years is presented by statistics and the current debate in the criminal practice. In the current practice offers each probation agency in detail the varied program and the offer for training and the training of probation officer. At the same time first classifies the probation office the volunteers after life situation, problem area or group of offenses. Consequently, assistance and control need is different. Thus, the probation officer can be specialized. In addition, the privatization of probation and the change in the risk-oriented probation can discuss critical to determine the Verbessungsmöglichkeiten the Probation system.
