소년사법보호제도의 구조와 도입가능성
독일 소년법원법 제38조와 아동․소년부조법 제52조에 법적 근거를 두고 있는 독일 소년사법보호제도는 단순히 소 년법원의 보조자 역할을 넘어서서 소년부조의 일부분을 구성하고 있는 소년정책의 핵심에 속한다. 그런 의미에서 독일 사회법 제8편 제52조는 소년법원보조라는 의미의 용어보다 “형사소송에서 소년부조의 협력”이라는 용어를 선택함으로써 더욱 중립적 의미와 지위를 부여하고 있다. 이러한 소년사법보호제도의 중심에서 활동하고 있는 전 문인력이 소년사법보호관이다. 소년사법보호제도는 리스트가 가이드라인을 발전시킨 소년법원운동에서 태동되어 소년범죄자에 대한 법적 특별 처우를 규정한 소년법원법을 낳기에 이르렀고, 거의 비슷한 시기에 소년부조기관에 관련된 규정이 소년복지법에 규정되기에 이르렀다. 소년부조제도의 조직적 기틀을 다진 소년복지법은 공적 소년부조기관이 아동과 소년의 교 육을 지원하고 감독하도록 규정하고 있었고, 아동과 소년의 교육이 위협을 당할 때 국가가 개입할 수 있는 구성요 건과 보호교육을 그 내용에 담고 있었다. 소년부조법과 소년형법의 이원적 체계는 이렇게 성립되었다. 현행 독일 법제에서 소년사법보호관은 조사기능, 감독기능 그리고 교육적 원호와 후견의 세 가지 기능을 수행하고 있다. 주로 소년형사절차에서 소년법원을 보조하는 기능을 수행한다는 점에서는 소년사법보호관의 조사와 감독기 능이 통제와 보고라는 일종의 억압적 업무를 수행하는 것이 사실이지만, 그보다는 소년사법보호관이 소년부조의 전문적 측면인 사회교육적 후견과제가 강조된 소년부조의 핵심적 기능을 수행하는 데에 더 중점이 있다고 보는 것 이 일반적이다. 이러한 소년사법보호관의 이중적 과제로 인하여 독일 소년부조 관련 이론과 실무영역에서 내적 역 할갈등 또는 역할충돌이라는 문제가 현재 제기되고 있고, 이를 극복할 다양한 개선노력이 경주되고 있다.
Struktur und Einführungsmöglichkeit der Jugendgerichtshilfe
The juvenile court (JGH) is gem. I §38 Juvenile Court Act (JGG) exerted by the youth services in cooperation with associations for youth services. As problem areas with respect to the organizational status and activities of the JGH can be particularly rename: Rellenkonflikt, stigmatization by reports on the problems of youth and the youth court walker problem, the question of the best organizational form of the JGH, the observable cooperation problems between lawyers and social scientists, the data protection issues, etc.
