보호관찰소 이전에 대한 갈등원인과 해소방안
본 논문은 최근 보호관찰소 이전과 관련하여 주민들과의 갈등을 겪고 있는 사례들이 발생함에 따라, 그 원인과 대책을 모색하는데 있다. 교도소 신축과 관련하여 간헐적으로 이러한 갈등현상이 있어왔지만, 보호관찰소이전과 관련한 갈등은 1989년 개청 이후 거의 없었다. 그러다가, 2013년 9월 성남보호관찰소 이전과 관련하여 처음으로 대규모 갈등이 발생한 이후 보호관찰소 이전과 관련하여 지역주민들의 반대로 어려움을 겪고 있는 실정이다. 기존의 갈등이 혐오시설, 즉 쓰레기 매립장과 같이 혐오스러운 시설이나, 원자력발전소, 교도소, 핵폐기물처리장과 같이 위험성이 있는 성질의 시설의 설치에 대한 반대가 주를 이루어 왔지만, 보호관찰소 입지를 둘러싼 갈등의 발생은 성범죄 등 위험범죄로부터 안전한 사회를 원하는 국민들의 욕구가 증가함에 따른 새로운 형태의 갈등현상이라 볼 수 있다. 갈등발생의 원인은 제도 도입초기 소년범에 대해서 실시할 때와는 달리 최근 전자발찌제도가 도입된 이 후 , 이들에 의한 성폭행 등 강력사건들이 발생하고 이러한 사실들이 언론에 보도되면서, 청사 인근 주민들이 범죄에 노출될 수 있다고 우려한 지역주민들의 청사입주 반대가 첨예화 되고 있는 것이다. 범죄로부터 지역주민의 안전을 지키는 책무를 수행하는 보호관찰소가 아이러니하게도 지역 주민들의 반대에 막혀 본연의 업무를 충실히 할 수 없다면 그 피해는 오히려 국민전체에 돌아갈 수밖에 없다할 것이다. 따라서 보호관찰기관 이전갈등과 관련된 원인분석과 대책마련을 통한 갈등의 원만한 해결은 절실한 과제라 할 수 있다.
The causes of conflict in the moving of Probation offices into community and how to solve the problem
The purpose of this study is to find the causes of conflict between probation offices which plan to move into new communities and local inhabitants in the communities and to suggest how to solve the problem in Korea. There had been a few such conflicts when the government built new prisons, however, we have never experienced it regarding probation offices since 1989 when probation system was introduced in Korea. Since the first and significant conflict between Sung-nam probation office and the community in September 2013, the Crime Prevention Policy Bureau is on hard time in dealing with communities against new probation building in their neighborhood. Historically there had been traditional conflicts caused by unpleasant facilities such as landfill, municipal waste treatment plants, or by hazardous facilities such as nuclear power plants and its waste dump site or prisons, and the new type of conflict caused by probation office buildings is based on the needs of citizens for safer society especially needs for the violent crime free society such as sex offence, kidnapping, robbery and so on. Local inhabitants around the probation offices (and people who will live around the probation offices in the future) are afraid of being victimized by the electronically monitored offenders who have the obligation to report in person in the probation offices. Probation offices exist to protect communities from crimes but ironically the conflict between communities and probation offices keep the probation system from its function of protecting people. As a result, the citizens in the country will not receive proper crime-prevention service when the probation system doesn’t work effectively because of the conflict. Thus, to find the cause and solve the conflict between probation offices and communities suggesting possible solutions is urgent matter.
