사회내자원을 활용한 수강명령 협력집행 활성화 연구 - 서울 S보호관찰소 사례를 중심으로 -
본 연구의 목적은 수강명령 협력집행 활성화 방안의 모색을 위한 기초자료를 마련 하는 것에 있다. 연구의 목적을 달성하기 위해 수강명령 협력집행에 관한 문헌연구 고찰, 서울 S보호관찰소를 중심으로 수강명령 대상자의 협력집행 및 장기분할 집행 의 수요 조사, 협력기관 모집・지정・실무자 교육・협력집행 과정 분석, 수강명령 협력집행 대상자 및 실무자의 경험을 탐색하였다. 연구 결과는 첫째, 수요 조사 결과 응답자의 64.6%가 협력기관에서 실시하는 장기 분할집행에 참여 의향을 보였다. 둘째, 협력기관 모집공고를 통해 모집된 2개 기관, 재지정 1기관을 포함하여 총 11회차의 수강명령을 진행한 결과, 대상자들은 협력기 관에서 실시하는 수강명령에 만족하였고, 수강 이후 4명의 대상자가 협력기관 프로 그램을 자발적으로 이용하였다. 셋째, 협력기관 미지원 사유 전화 조사 결과, 기관에 서는 강사료 및 예산의 불만족, 민원에 대한 우려, 공간 활용의 한계, 집행 업무에 대 한 부담감, 인력 부족, 가해자 집단상담 경험부족 등을 이유로 협력기관 지원을 하지 않은 것으로 나타났다. 넷째, 수강명령이행 및 집행경험에 대한 질적 연구 결과, 대 상자들의 수강명령 이행 경험은 ‘상한 감정을 안고 수강명령을 이행하면서, 소통과 공감을 통한 치유 과정을 경험하였고, 삶의 변화를 가져다준 시간’으로 주제를 도출 하였다. 협력기관 실무자의 협력집행 경험은 ‘협력집행의 기대와 포부를 가지고 교육 에 임하였고, 마음열기 과정을 통해 대상자들의 변화를 느끼면서 협력집행의 활성화 방안을 되짚어 봄’으로 주제를 도출하였다. 본 연구 결과를 토대로 사회내자원을 활용한 수강명령 협력집행 활성화 방안으로 대상자의 수요에 따른 수강명령 협력기관 집행 방식의 다양화 및 적절한 배치, 현실 적인 강사료 책정 및 교육 운영비 지원 등의 예산 확보, 강사의 전문성 향상 및 교육 내용 표준화에 대한 시스템 구축, 사회 내 자원을 관리하는 별도 센터의 설립을 제안 하였다. 본 연구를 통해 협력집행 활성화의 필요성을 확인하였고 협력집행 정책 방 안의 방향을 제시하였다는 점에서 연구의 의의가 있다.
Promoting Partnerships with Private Organizations to Facilitate Court-Ordered Programs - with a focus on cases at S Probation and Parole Office -
The purpose of this study is to construct foundational data and guidelines for promoting and utilizing private organizations to offer court-ordered treatment programs. We have utilized literary research and conducted a survey to collect data on the demand for private court-ordered program providers as well as intermittent long-term programs for clients at the S Probation and Parole Office located in Seoul. We have also investigated the entire process, starting from partnership request and establishment, staff training, and the delivery of designated programs to clients. Additionally, we have examined the practical experiences of both clients and practitioners throughout this process. We found that 64.6% of court-ordered program clients express a positive intention to participate in intermittent long-term programs provided by private organizations. Clients who participated in 11 treatment sessions, conducted by two newly appointed organizations and one reappointed organization, reported high satisfaction, with four clients choosing to continue treatment voluntarily. Telephone research revealed that organizations hesitant to provide services expressed concerns about compensation, personnel, facilities, and group counseling experience. Additionally, they felt burdened by the responsibility of enforcing the law and receiving complaints from clients. Furthermore, our qualitative research has focused on the theme of ‘healing the broken mind and inspiring positive change through empathetic communication’ from the perspective of our clients. In contrast, lawenforcement professionals have explored how ‘witnessing clients open their hearts and undergo positive transformations has instilled hope in building partnerships promoting them’. To further harness community resources and promote partnerships for the facilitation of court-ordered programs, we have proposed several suggestions: diversifying program methods to better meet the needs of clients, securing a budget to adequately compensate private instructors, standardizing program content, enhancing instructor expertise, and establishing a dedicated office for managing community resources. The significance in this study lies in its emphasis on the importance of promoting partnerships with private organizations and its provision of a pathway for relevant policy measures.
